It seems that the term "ork" is a trademark of Games Workshop. http://www.games-workshop.com/gws/content/...002&start=5 I do know there was a legal case in the late 1970's where Tolkien's estate went after TSR games. That is why in the first printings of D&D halflings are refered to as "hobbits" and trents are refered to as "ents". After the lawsuits resolution, Gygax and TSR were forced change the names.
