diabloiij Posted February 13, 2009 Posted February 13, 2009 If I see someone is selling my friend's MOC on eBay. Will I be able to report this seller and also will eBay actually do anything to his auction since my friends MOC is not trademarked obviously. That is stealing in my opinion. thank you guys. Quote
Siegfried Posted February 13, 2009 Posted February 13, 2009 Any chance of a link? eBay probably won't do much though unless lawyers get involved, but they have taken down jewelry fakes in the past. However it's more for trademark issues than the design itself. Quote

I don't sincerely believe in rights of ownership for things we build out of stock parts. If it involves something we actually create, like a decal or design that isn't a copy of a real one, sure. I've been a bit disturbed lately by people selling items that use printed copies of legally trademarked names and logos, though that's unrelated to this situation as far as I know. Don't expect anything to be done about it, it's her word against theirs and you've made it clear they have no legal documentation to present. Still sucks, if that counts. Sorry there isn't likely anything to be done about it, but a link would be informative as Sinner asked. Quote

If you see it is being sold as a regualr set you can report them to e-bay. It would count as fraud then and will be taken down. But you can always report it to e-bay. If they think it is wrong they'll take it down. At least you will have tried to do something about it. Quote
xenologer Posted February 15, 2009 Posted February 15, 2009 If you don't want someone to copy a design, then don't put it on the internet. If your friend posted instructions to build the model publicly then what did he expect would happen? someone was bound to make one and then do who knows what with it. If your friend didn't post instructions, then the copycat must be an imitation but not an Exact copy; in which case he isn't Really selling your friends MOC now is he? People copy ideas all the time, just live with it. Quote

Ya, I think you are right. my friend didn't post instructions but it was a very small but nice vehicle around 30-40 piece, people can obviously build it without instruction. I did contract the seller, he was very nice and told me he was selling his son's Lego for him and didn't know about this issue and he said he will take the vehicle apart and sell it as loose bricks.
