August 8, 201410 yr The face itself probably isn't trademarked (it's pretty much just a Smiley face), but the minifig as a whole is, as well as the individual parts Since it doesn't make sense to use the face without the rest of the minifig, I guess it can be considered trademarked
August 8, 201410 yr I don't think facial expressions can be copyrighted/trademarked. The minifigure as a whole, yes but not an expression.
