No. The creator left it public domain. But the yellow, round smiley face, the one in pins and stuff is copyrighted I believe.

I don't think LEGO pays for it though, if that was what you were wondering.

He isnt talking abiut that. He is talking about the minifig head and face as pictured.

The face itself probably isn't trademarked (it's pretty much just a Smiley face), but the minifig as a whole is, as well as the individual parts :wink: Since it doesn't make sense to use the face without the rest of the minifig, I guess it can be considered trademarked :sweet:

I don't think facial expressions can be copyrighted/trademarked. The minifigure as a whole, yes but not an expression.
